You will make an Immigration Law consultation appointment with SICON’s RCIC-IRB through Google Meeting.

Based on the information you provide and the questions you ask, the Regulted Immigration Consultant will provide advice based on the law at that time to answer your questions as well as guide you on a most suitable immigration pathway to Canada.

GCMS NOTES

TEMPORARY RESIDENCE

SICON receives client applications for temporary residence applications, extensions, and restorations according to the following categories:

VISITOR VISA: When you want to visit Canada for a short term, you can apply for this type of visa (TRV) to enter and stay in Canada for up to six months.


SUPER VISA: The government allows parents and grandparents to reunite with their children and grandchildren in Canada for up to five years. After that, they can extend their stay within Canada for another two years, bringing the total stay period up to seven years.

Foreigners from visa-exempt countries must obtain an electronic travel authorization (eTA) if they wish to fly to or transit through Canada by air. Registering for an eTA is an inexpensive online process (CAD$7 per person). Typically, eTA approvals are sent via email within minutes and are valid for 5 years.

OFFSHORE: Clients have two choices: the regluar program which requires proof of finance and the non-financial proof program (SDS Stream). Depending on each client’s situation, SICON will assist in evaluating and recommending the most suitable program.


ONSHORE: If you are within Canada, you will still be eligible for this permit under certain specific circumstances.

LMIA: A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker.

A positive LMIA will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job. A positive LMIA is sometimes called a confirmation letter.

Before a foreigners can apply for Closed Work Permit, please proceed with the LMIA. If you are employed by a business owner and need to obtain a permit to qualify to hire foreign workers, SICON can assist your employer in applying for an LMIA.


LMIA-CLOSED WORK PERMIT: Normally, foreigners who want to work in Canada need a work permit. The term of the work permit will be tied to the contract term offered by the Canadian employer, usually one or two years.

POSTGRADUATION WORK PERMIT (PGWP): If you graduate in Canada and meet certain specific conditions, you can apply for this work permit.


SPOUSAL OPEN WORK PERMIT: If you are the spouse or partner of an international student, work permit holder in Canada, or are applying for spousal sponsorship, you can apply for this type of permit.

CHANGE YOUR STATUS OF RESIDENCE: In some cases, you can still change your type of status within Canada.


EXTENSION: Temporary residence status can be extended by applying to IRCC to extend your stay in Canada. If approved, a Visitor Record with a new expiration date will be issued.


Note: As long as the renewal application is submitted before the expiration date, the temporary resident will benefit from the implied status. Temporary residents under implied status may remain in Canada under the same conditions until a decision is made.


LOSS OF STATUS: Once a temporary resident has overstayed, they may be eligible to apply for restoration of status within 90 days of loss, if they continue to comply with the original conditions. If not, they must leave Canada.

Non-admitted foreigners require special permission to enter or remain in Canada. Temporary residence permits (TRPs) are only issued in exceptional cases.

To overcome inadmissibility, the officer must be convinced that the reasons for entering and remaining in Canada outweigh any health and safety risks to Canadian society.

PERMANENT RESIDENCE

If you are a permanent resident or Canadian citizen, and meet the conditions of each type of sponsorship, you will be able to sponsor your grandparents, parents, spouse, partner, and children to come to Canada to live with you.

If you are a highly skilled worker, have qualifications, experience, appropriate language proficiency and the necessary financial capacity, you have the opportunity to apply for permanent residence for you and your whole family while living in or outside Canada through the Express Entry and Provincial Nomination programs, or the Business stream.

You can file while you are in or outside Canada, and you can apply even if you are out of status in Canada. However, you need to demonstrate the hardships you will face when leaving Canada.

Once you are recognized as a legal refugee in Canada, you can apply for permanent residency.

If you stay the required number of days and do not intend yet or qualify to apply for Citizenship, you can extend your PR Card to maintain permanent resident status in Canada.

In case you do not stay the required number of days but have convincing reasons and evidence, you can extend your permanent resident card.
